01Acceptance of terms
These Terms of Service govern your use of our website, www.valleyservices.biz, and the services Valley Services provides. By using the website or ordering a service you agree to these terms and all applicable laws. If you do not agree, please do not use the website or our services.
02Our services
Valley Services rents roll-off containers, portable restrooms and restroom trailers, sink and water stations, temporary fencing and barriers, and operates a public construction and demolition drop-off site in San Jose. Specific terms, prices, rental periods, delivery and pickup details are set out in the quote, rental agreement, scale ticket or invoice for your order. Where those documents and these terms differ, the signed document for your order controls.
03Your responsibilities
When you use our website or services you agree to:
- Provide accurate and complete information, including a safe, legal placement location and site access.
- Use rentals only for their intended purpose and in compliance with all laws, permits and regulations.
- Keep prohibited materials out of containers and off the drop-off site (hazardous waste, chemicals, paint, asbestos, electronics, fluorescent bulbs, tires, wet food garbage and pressure-treated wood, among others). Prohibited items may be refused or billed at cost of proper disposal.
- Not overload containers past the rim or past the weight limit for the size you rented.
- Not move, relocate or modify rented equipment, or allow damage beyond normal wear.
- Not interfere with the website, our servers or networks.
04Quotes, pricing and payment
Quotes are flat rates that include delivery, the standard rental period, pickup and disposal up to the stated weight limit unless your quote says otherwise. Additional charges may apply for overweight loads, extended rental, mid-rental swaps or service calls, prohibited items, blocked access or failed deliveries, and damage beyond normal wear. Drop-off site charges are based on material type and scale weight and are due at the time of visit. Invoices are due as stated on the invoice. Late payments may incur charges allowed by law, and we may suspend service for non-payment.
05Delivery, placement and pickup
We deliver and place equipment where you direct us when it is safe and legal to do so. You are responsible for obtaining any permit required for street or public right-of-way placement and for any damage to surfaces, such as driveways, from equipment placed at your direction. Delivery and pickup windows are estimates. We will communicate changes as soon as we can, but we cannot guarantee specific times.
06Rented equipment
Equipment remains the property of Valley Services at all times. You are responsible for its care from delivery until pickup, including loss, theft or damage beyond normal wear. Report damage, tipped units or safety concerns to us immediately at (408) 297-5404.
07Text messages
By opting in to text messages from Valley Services you agree to receive service updates, delivery reminders and, where you chose it, promotional messages. Message frequency varies and message and data rates may apply. Reply STOP to cancel or HELP for help. Your mobile information is handled as described in our Privacy Policy and is never shared with third parties for marketing.
08Intellectual property
All content on our website, including text, photos, video, logos and design, belongs to Valley Services or its licensors and is protected by law. You may not reproduce, distribute or modify it without our written permission. Materials you send us, such as site photos, remain yours; you grant us a limited license to use them to complete your order.
09Third-party links
Our website may link to third-party sites, such as our careers page or map services. We are not responsible for their content or practices.
10Disclaimers and limitation of liability
The website and services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the website will be uninterrupted or error-free.
To the fullest extent permitted by law, Valley Services is not liable for indirect, incidental, consequential or punitive damages arising from the use of, or inability to use, our website or services. Our total liability for any claim will not exceed the amount you paid us for the service at issue.
11Indemnification
You agree to indemnify and hold harmless Valley Services and its employees, contractors and agents from claims, damages, losses and expenses, including reasonable legal fees, arising from your use of the website or services, your violation of these terms, materials you place in our equipment or bring to our site, or your violation of any third-party rights.
12Changes, suspension and termination
We may modify, suspend or discontinue any part of the website or services at any time. We may suspend or end service for breach of these terms or non-payment. Provisions that by their nature should survive, including payment obligations, disclaimers, limitation of liability and indemnification, survive termination.
13Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes arising from these terms or our services will be resolved in the state or federal courts located in Santa Clara County, California.
14Changes to these terms
We may update these terms from time to time. Changes are posted on this page with a new effective date. Continued use of the website or services after a change means you accept the updated terms.
